Secrecy in Ohio Environmental Law

Abstract

In an effort to encourage voluntary corporate compliance with environmental regulations, Ohio law contains an Audit Privilege and a Voluntary Action Program, both of which allow companies to avoid public disclosure of potentially damaging environmental information in certain circumstances. These laws conflict with other laws aimed at providing the public with access to information about risks of environmental hazards created by corporate actors. In this presentation, I will discuss legal and ethical bases of state-fostered secrecy in environmental law, contrasting the costs and benefits of secrecy in the environmental context with the costs and benefits of secrecy in other legal contexts.
